Auftragsverarbeitungsvertrag nach Art. 28 DSGVO

Wenn Sie billcu als Kunde einsetzen, werden die in Ihrer Instanz gespeicherten Daten (z. B. Rechnungs-, Kunden- und Vertragsdaten) ausschließlich in Ihrem Auftrag und nach Ihren Weisungen verarbeitet – Sie bleiben Verantwortlicher im Sinne der DSGVO, wir sind Auftragsverarbeiter.

Auftragsverarbeiterin ist die AWIBE Ltd. (HE 480408), Anthypolochagou Georgiou M. Savva 26, Shop 1-2, 8201 Geroskipou, Paphos, Republik Zypern – sie betreibt die bestehenden Kunden-Instanzen. Die Website wird von der billcu AI Ltd (HE 495710) betrieben, einer 100-prozentigen Tochter der AWIBE Ltd. Eine Übertragung des Betriebs auf die billcu AI Ltd ist vorbereitet; sie erfolgt nur mit vorheriger Information der Kunden und nach den Regelungen des jeweiligen AVV.

Grundlage dafür ist ein Auftragsverarbeitungsvertrag (AVV) nach Art. 28 DSGVO, den wir mit jedem Kunden vor Aufnahme der Verarbeitung abschließen. Der AVV umfasst insbesondere:

  • Gegenstand, Dauer, Art und Zweck der Verarbeitung sowie Datenkategorien und betroffene Personen
  • technische und organisatorische Maßnahmen (TOMs) – u. a. EU-Hosting in Deutschland (AWS Frankfurt), eine isolierte Instanz mit eigener Datenbank je Mandant, TLS-Verschlüsselung, rollenbasierte Zugriffskontrolle und verschlüsselte tägliche Backups
  • die Liste der eingesetzten Subunternehmer (Subprozessoren)
  • Unterstützungs-, Lösch- und Nachweispflichten sowie Kontrollrechte des Kunden

Data Processing Agreement (DPA)

Data processing agreement pursuant to Art. 28 GDPR

When you use billcu as a client, the data stored in your instance (e.g. invoice, customer and contract data) is processed exclusively on your behalf and according to your instructions – you remain the controller within the meaning of the GDPR, and we act as your processor.

The processor is AWIBE Ltd. (HE 480408), Anthypolochagou Georgiou M. Savva 26, Shop 1-2, 8201 Geroskipou, Paphos, Republic of Cyprus – it operates the existing client instances. This website is operated by billcu AI Ltd (HE 495710), a wholly owned subsidiary of AWIBE Ltd. A transfer of operations to billcu AI Ltd is prepared; it will only take place with prior notice to clients and in accordance with the terms of the respective DPA.

This is governed by a data processing agreement (DPA) pursuant to Art. 28 GDPR, which we conclude with every client before processing begins. The DPA covers in particular:

  • subject matter, duration, nature and purpose of the processing, as well as data categories and data subjects
  • technical and organisational measures (TOMs) – including EU hosting in Germany (AWS Frankfurt), an isolated instance with its own database per tenant, TLS encryption, role-based access control and encrypted daily backups
  • the list of sub-processors used
  • support, deletion and documentation obligations as well as the client's audit rights
